Terms of service

DayTradingSoftware provides software for scanning US stocks, alerts, watchlists, a trading journal, analytics, simple backtests, an AI day review and risk calculators. It does not provide investment advice, does not recommend securities, does not execute trades and does not hold funds. Scan results are matches to filters and are not signals. Please read the risk disclosure, which forms part of these terms.

You must be at least 18 years old, give a valid email address and keep your password confidential. You are responsible for activity under your account. Desk owners are responsible for the seats and roles they assign.

Plans are sold as monthly or yearly subscriptions at the prices shown on the pricing page at checkout. Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time in the dashboard; cancellation stops the next renewal and you keep access until the end of the period you have paid for.

Each plan includes limits such as saved scans, active alerts, backtests and AI day reviews. Limits on things you use up, such as backtests and AI day reviews, are counted as usage in the current billing period and reset with the next period. Deleting a backtest or a review does not restore the allowance.

Moving to a higher plan or from monthly to yearly billing charges the prorated difference immediately and the new plan starts once that payment succeeds. Moving to a lower plan takes effect from the next period, without a refund of the difference.

Payments are final except as described in our refund policy. Prices are in US dollars, and applicable taxes may be added at checkout.

Real-time market data is licensed from exchanges through a licensed market data provider. Unless you are on a Desk plan with the appropriate status, the data is for your personal, non-professional use only.

When you activate real-time data you must truthfully declare whether you are a non-professional or professional subscriber under exchange rules, and update the declaration if your status changes. A false declaration may lead to suspension and to fees charged by the exchanges.

You may not redistribute, resell, publish, stream or store market data outside the service, including through screenshots or exports meant for third parties, except as exchange rules permit.

• Share your login or let several people use one seat.
• Scrape, copy or systematically extract data or content from the service.
• Reverse engineer, attack, overload or test the vulnerability of the service without permission.
• Upload files containing malware or data you have no right to use.
• Use the service to break any law or the rules of your broker or exchange, including market manipulation.

We may suspend or close accounts that break these rules.

You keep ownership of the trades, notes and files you add. You give us a limited licence to store and process them only to provide the service to you, including the AI day review when you request it. Our privacy practices are described in the privacy policy.

The service, market data, analytics, backtests and AI summaries are provided as is and as available. We do not guarantee that they are accurate, complete, timely or uninterrupted, and we are not responsible for decisions you make based on them. Past performance and backtests do not guarantee future results.

To the fullest extent permitted by law, the administrator of the daytradingsoftware.com service is not liable for trading losses, lost profits, indirect, incidental or consequential damages, or losses caused by data delays, outages or errors. Total liability for any claim is limited to the amount you paid for the service in the three months before the claim. Nothing in these terms limits liability that cannot be limited by law, or the mandatory rights of consumers.

We may change these terms with notice by email and on this page. If you do not agree with a change, you can cancel before it takes effect. You can close your account at any time, and we may end the service for an account that breaches these terms.
